The New Hampshire Public Utilities Commission upholds its previous decision that it has authority to regulate IP-enabled cable voice service, i.e., fixed VoIP service.  Although recent legislation restructured the state’s regulation of telephone public utilities, the PUC concluded it maintains jurisdiction to determine the proper regulatory categorization of Comcast’s digital voice service (CDV). 

Among other things, it found that Comcast’s CDV constitutes an IP-enabled service, that Comcast should be regulated as an Excepted Local Exchange Carrier (ELEC), and that the minimal state regulation imposed on Comcast as a provider of CDV is not preempted by federal law.
