Vermont

The Public Service Board issued a procedural order in the investigation into regulation of VoIP services. It has requested that the parties submit (by October 31, 2013) a list of stipulated facts and a list of issues that may require live surrebuttal testimony at the technical hearing scheduled for December 5, 2013. In a 2010 order, the Board concluded that while nomadic VoIP services are not subject to regulation under Vermont law, fixed VoIP service is subject to the Board’s authority to the extent the calls are intrastate as opposed to interstate. In April 2013 this case was remanded to the Board by the Vermont Supreme Court with instructions to rule on the question of whether fixed VoIP is an information service or a telecommunications service.
